Utah County Court Records
According to UCJA Rule 4-202.01, Court records are formal written or digital copies of proceedings that have been created, acquired, received, or kept by a court or its administrative office at a court. They may include books, documents, letters, papers, maps, blueprints, photographs, videos, cards, tapes, audio recordings, figures, and other reproducible items. In Utah County, court records are maintained by the clerks of the District and Justice courts per the Utah Court Rules. Court records aid in informing the public about the law, responsibility, and repercussions of violations. They assist in identifying and addressing policy gaps and evaluating the courts' performance.
Are Court Records Public in Utah County?
Yes. According to UCJA Rule 4-202.02 and the Utah Government Records Access and Management Act (GRAMA court records are considered part of Utah County Public Records unless they are confidential or exempt from public disclosure. The majority of court records in Utah are available for viewing and copying. However, some documents are exempt from this Act. According to the UCJA Rule 4-202.02(3)-(8), court records that are not open to the public include:
- Sealed Records: These include expunged records, actions for disease testing, gestational agreements, documents revealing a confidential informant's identity, and any record of the findings of an investigation conducted by the Children's Justice Center following any court case.
- Private Court Records: They include judgment information statements, jail booking sheets, American with Disabilities Act requests for accommodations, records of alternative dispute resolution, and accounts of Child Protective Services investigations.
- Protected Court Records: These include documents covered by the attorney-client privilege, bids or proposals (until the period for submitting has ended), plans for court security, confidential business information, and a record whose revelation could endanger people's lives, safety, or property.
- Juvenile Court Social Records: These include psychiatric, psychological, and medical evaluations, evaluations related to child custody, parenting time, parental fitness, substance abuse, and domestic violence, and reports or assessments from probation agencies and institutions.
- Juvenile Court Legal Records: These include referral and offense history, party or minor name, calendars, minutes, affidavits, motions, summonses, subpoenas, findings, orders, and decrees, and court hearing records.
- Safeguarded Court Records: Such records include sensitive and personal information relating to a crime victim or witness
What Do Utah County Court Records Contain?
Per Per UCJA Rule 4-202.02(2), public court case information include but are not limited to:
- Case files
- Audit reports
- Appellate filings, including briefs
- Abstract of a citation that redacts all non-public information
- Arrest warrants, but a court may restrict access before service
- Aggregate records without non-public information and personal identifying information
- Indexes approved by the Management Committee of the Judicial Council that contains the following information:
- File date
- Party name
- Daily calendar
- Attorney name
- Amount in controversy
- Case number and status
- Civil case type or criminal violation
- Civil judgment or criminal disposition
- Licensed paralegal practitioner name

How to Conduct a Utah County Case Records Search
A Utah County case records search can be done online, by mail, email, or in person at the Utah County Justice Court. Online requesters must submit an Online GRAMA Request Form. Requesters must describe in detail the types of court records they want. The processing time is 10 business days. The Court will send email notifications to the requester regarding the status of their request. A court record request may be fulfilled for free, but fees may be charged for search, retrieval, and other direct administrative costs. The first 15 minutes of research and response is usually free, but $25.00 per hour may be charged.
Mail and email requesters must submit a completed Utah County Government GRAMA Request for Records Form to the Court. Email requests should be sent to justicecourt@utahcounty.gov. In-person requests should be made during business hours (Monday - Friday, 8 a.m. to 4:30 p.m.). A case number or party name would be required to complete the request.
A record seeker can request a copy of an audio record at the Fourth Judicial District by emailing a Request for Copy of Audio Record form to recordingrequest4th@utcourts.gov. Attorneys must electronically file the form in the appropriate case. Compact Discs and emailed MP3 files cost $15 each for up to a half-day hearing. Individuals who want the CD(s) to be mailed to them should be willing to pay a mailing fee. The processing time for audio requests is 10 days.
Utah County Civil Case Records
A civil case record is a non-criminal court record that provides information about a dispute or problem between two parties in Utah County. The Fourth Judicial District has full authority to hear and determine all civil disputes like eviction, debt collection, contract, and family law, excluding other than small claims. Small claims are handled by the Justice Court. Public civil case records can be accessed through the public terminals available at Utah County District Court locations. The Public terminal provides free XChange access to requesters. However, it is advisable to call the courthouse ahead of time to verify that they have XChange access. Additionally, MyCase online tool is available in all District and Justice Court locations. Case parties can only use this tool to find civil case records. Alternatively, requesters can use the Utah County Justice Court's GRAMA request form to request copies of Civil Court records online, by mail, or by email.
Utah Criminal Court Case Records
A criminal court case record is a document that details the court procedures about a claim made by Utah County against a criminal. The Utah County District Courts handle class A misdemeanors and all felony cases, while the Justice Court handles class B and C misdemeanors, infractions, and ordinance violations. Individuals can use the public terminal at the courthouse where the case was held to get Utah criminal court case records. Anyone wanting copies of the Utah County Justice Court criminal records must request a GRAMA. Typically, there is no charge for viewing or inspecting a criminal court case record, but copies of such records come with a cost.
How to Get Court Records Online for Free
Case parties can get court records for free online through the MyCase tool available on the Utah State Court's website. To find this tool, Click on the "Record" menu at the top bar of the website and click the MyCase link at the dropdown. Requesters must create a MyCase account to be able to access case records for free. An email address, case number, and a government-issued ID to sign up. The requestor's identity will be verified, and they will receive an email with instructions on how to access the system.
